I've heard several smart legal scholars say that the Adam Walsh Child Protection Safety Act of 2006 is not likely to be relevant in Foley's case, as was initially thought, for some technical reasons.

It probably doesn't matter, what with the flood of new revelations coming out against Foley's past behavior.

He's a pervert, and one interested in teenagers, but yes, technically he's not a pedophile (or preferably, pedarist), which involves pre-pubescent, sexually undeveloped children.

hrm.. I agree.. He's sick.. but does not fit the description of "pedophile". He certainly doesn't belong in politics.. or anywhere near a Child Protection Act, if not mainly because the general public will not see a difference, I didn't know the difference until I looked it up....

FYI, from wikipedia: "Pederasty has historically been given sharply different meanings, sometimes referring to male homosexuality in general and sometimes specifically to homosexual male pedophilia. In academic usage the word has still a third meaning, referring specifically to the age-structured homosexuality practiced in classical Greece between older men and adolescents, and by extension to age-structured homos...

He has no righteous defense. Anyone in an elected position is aware that the reason that the voter registration age is set where it is primarily is due to the fact that despite the various ages assigned to "maturity" that firm judgement and responsible decision making skills occurs at a later age for many Any one who is fully aware of that and is an elected official that would engage in any such person at an age younger than that is just premeditatedly manipulative and take advantage of someone who may not possess the ability to say no based on responsible judgement.

Whether he is found innocent or guilty and whatever they call it, if it is something he wouldn't want the voters to kn...

I hate Foley, but Foley is NOT a pedophile. That's true.

There is NO physical difference age-wise between a 16-year-old and an 18-year-old. Really, there is NOT. We see it all the time, where a 16-year-old girl can easily lie about her age and say that she's 18 years old or 19 years old, and you really cannot tell the difference between the two, and that's because a 16-year-old has that of an adult-like body. Pedophiles are interested in that of the child-like body. A 12-year-old girl, for instance, could never pass as an 18-year-old physically-wise, and that's because a 12-year-old girl is that of a child-like body. Pedophiles sexually like children of ages 12 and under or a person who h...

(as mid-to-late teenagers are that of an adult-like body, which is why they don't look any different age-wise from most young adults...ages 18-23). It's also why the DSM IV does not have ephebophilia (sexual attraction to a mid-to-late teenager) as a diagnostic category...because most men and women are ephebohiles, as in 18-year-olds are teenagers as well, and 16-year-olds can easily look 18.

Foley would be a statutory rapist in some places for engaging in sex with 16-years-olds or 17-year-olds, but he has NO mental disorder, like pedophiles have a mental disorder...just as a 19-year-old who has sex with his 17-year-old girlfriend has NO mental disorder. Foley instead has a problem with o...

are acting as though our 16-year-olds don't know how to defend themselves, or to say no to someone they don't want to have sex with. Our 16-year-olds are not in the mindset of 6-year-olds, and with us treating them like they are, how can we possibly expect them to be called adults at age 18? Especially our 17-year-olds who are one year away from being age 18, goodness. 16 and 17-year-olds are just as physically strong as 18-year-olds. I see 16-year-old football players who are just as physically strong as 18-year-old football players all the time, mentally, they are as well. My 16-year-old brother even asked why the news was acting as if he was a mindless or helpless 5-year-old. He's outraged at that notion.

Mostly excellent points, with some exceptions:

He has created mass hysteria with people calling him a pedophile when he clearly is not.

He didn't do this, the irresponsible, despicable news media, and those seeking political advantage did.

Foley is not mentally ill for being sexually attracted to a 16-year-old or 17-year-old

You left out the sex of the "16 or 17 year old". You also left out that attraction, and acting on it, are two different things.

If you find that running someone who has just cut you off in traffic, off the road to a fiery death, attractive in a flash of emotion, you're fairly normal. If you are compelled by that emotion, you're insane.

No doubt Foley is a despicable.
Has the age of the "child" been determined?
I heard the ABC story had been proven false by a blogger ( I think called Passionate America, I have not searched).
Just wondering.
If so, the double-standard by the media and democrats would be glaring.

That's an on-going given at this point and not dependent on this issue.

Our punitive obsession with controlling sexual behavior is one of the most defining features of American culture.
