Yup, they caved. I guess that episode one is not (or at least it wasn't a few days ago) available on ITunes and it was not aired during a recent 'Heroes' marathon.

This lawsuit seems especially frivolous when you consider that:


even though the trademark is clearly visible on what I'm told is called the flange (I'm no Bob Vila) of the disposal it's in tiny print. So even if you own a 50-inch HD plasma TV, I doubt that you would have noticed the InSinkErator name.

Is anyone surprised they caved? It is soo friggin easy to get in a lawsuit against a big company in the US.. I still can't believe some dumb ass spilled HOT COFFEE on themselves and got like a million dollars for it.. IT WAS COFFEE! Coffee is hot... I mean, come the $%#& on...

I never even noticed a damn label on the device.. and according to bunni's quote it was impossible to see anyway... By caving and digitally removing the label, they've given the company ammo in their court case...

Stupid.. and i agree whole heartedly with GD (OMG!), Unbelievable!!!

Mousie, I'm not doubting that Mc'Ds made coffee that was very hot... they may eve be to blame some for it (though it is coffee, and it is hot, and if it is not hot enough, people complain... etc )

My issue is that in the US you seem to be able to sue for anything, and make a big buck if you win.. I mean even the $480,000 she got after the appeal was ludacris... (of course that may have been the cost of the medical bills, etc.. we have more or less free health care in Canada, so I have no idea)

IMO, however, it' should have been caveat emptor... (buyer beware). I mean.. coffee == hot, unless it is iced coffee, in that case it should be cold. Regardless if it was 20F hotter than normal...

NBC caved because it's cheaper than going through with the trial. Most big companies will do this.

I wish Clipmarks would have left us with the ability to see larger avatars though. These xx yr old eyes have a hard time and I'm wondering if this is fruit for eyes? How did you put this together, if you did? And is this your Halloween costume?

Bookchick, your post confused me for a second. A couple of days ago, I was using a picture of me wearing a bunnicula costume . Now, I am using a picture of a creepy-looking, dressed-up cabbage.
