The refusal to dismiss the case against Proposition 8 means it will proceed to trial in January, unless appeals delay it.

If procreation is to be prerequisite for marriage, then no m-f couple should be allowed to marry unless the bride is pregnant so they can demonstrate their ability to do so.

Even then, would not the groom have to prove somehow the expected child is his? Maybe I can find a bible verse to tell me how to accomplish that, but I doubt it.

If natural childbirth is the sole reason for sanctioning marriage, then everyone should undergo fertility testing and only fertile couples can marry: same or opposite sex. Fertility is essential to the natural process.
