They are not being held under a legal precedent. They are being held under a legal technicality. Cuba isn't U.S. soil.
A U.S. embassy in any country is considered to be U.S. soil. If they claim Authority, they must also be held to their own authority, which includes the constitution, and that Guantanamo bay is as de facto US, as any other foreign embassy.
