A bit of history: the Constitution was written to facilitate a slower process of legislating so that bills could be reviewed, debated, and responded to in a fashion that reflected the PEOPLE’S preferences. The Founders knew that any government that could pass anything it wanted at warp speed would swiftly plunder and exhaust the treasury as well as run after every fad that came along. Since the financial crisis in late 2008, the White House and Congress has functioned on the basis of government-by-crisis. If restoring stability to the banking sector (the TARP bill) wasn’t enough, the Obama administration told Americans that General Motors and Chrysler had to be saved rather than permitted to go into bankruptcy and be restructured. Then Americans were told that billions had to be borrowed and spent to “stimulate” jobs. All of these bills were passed too swiftly for serious analysis and rebuttal.

Well, if Congress moves to seal the deal, oil prices will probably keep on falling. That’s the way traders work. They discount the future. Psychology and expectations can turn on a dime. The congressional ban on offshore drilling expires September 30, so that becomes a key date. A new report from Wall Street research house Sanford C. Bernstein says that California actually could start producing new oil within one year if the moratorium were lifted. The California oil is under shallow water and already has been explored. Drilling platforms have been in place since before the moratorium. They’re talking about 10 billion barrels worth off the coast of California. There’s also a “gang of 10” in the Senate, five Republicans and five Democrats, that is trying to work a compromise deal on lifting the moratorium. So it’s possible a lot of action on this front could occur much sooner than people seem to think. Deregulate, decontrol, and unleash the American energy industry.

First of all, I have to admit Sarah Palin did show some class in her thoughts on the passing of Ted Kennedy. But her followers, well, that’s a different story. It is no surprise that there are people who hated everything Ted Kennedy stood for. But to express this kind of hate upon learning he died is crass and graceless. As it happens, I don't think waterboarding as administered by the CIA was torture. But Pelosi says she does. If that's where you're coming from, how do you get off the hook by saying you only knew about a plan to torture but not actual torture? To establish torture conspiracy, a prosecutor wouldn't even have to prove an overt act in furtherance of the conspiracy. You just need to show that two or more people agreed to commit the prohibited act. Here, though, by her own account (or at least one of her own accounts), Pelosi knew the CIA was planning to use waterboarding and later learned it was actually being done.

It is clear, as was beautifully laid out in an article published by Glenn Greenwald in Salon magazine on July 15, that House Speaker Nancy Pelosi (D-CA) and the rest of the Democratic Party leadership both in Congress and in the party organization, have been blocking any action on impeachment for fear of having their own complicity in Bush’s and Cheney’s crimes revealed. As Greenwald notes, the Washington Post has reported that Pelosi, along with Sen. Jay Rockefeller (D-WV) and Rep. Jane Harman (D-CA) were briefed on the administration’s use of torture and not only didn’t object, but actively encouraged it. Rockefeller and Harman, who at the time were minority leaders of the Senate and House Intelligence Committees at the time, were also briefed about Bush’s order to the National Security Agency to conduct warrantless spying on Americans.
