POPSPublic defenders refuse new cases Citing unethical level of defense that results from huge caseloads. I have personally seen how egregiously unjust our justice system can be toward people without means to hire attorneys. They are virtually helpless, and an unethical prosecutor looking for votes can chew them up and spit them out for personal gain.

POPS Ego And Mouth by Thomas Sowell . . . by those who have accomplished something, and give it to whomever he chooses in the name of "spreading the wealth," is the kind of casual arrogance that has led to many economic catastrophes in many countries. The equally casual ease with which Barack Obama has talked about appointing judges on the basis of their empathies with various segments of the population makes a mockery of the very concept of law. After this man has wrecked the economy and destroyed constitutional law with his judicial appointments, what can he do for an encore? He can cripple the military and gamble America's future on his ability to sit down with enemy nations and talk them out of causing trouble. Add to Obama and Biden House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid, and you have all the ingredients for a historic meltdown. Let us not forget that the Roman Empire did decline and fall, blighting the lives of millions for centuries.

In this latest blast Obama is accused of being in some conspiracy with the Iraqi government. Here is the big Conspiracy: He told the Iraqi government what the USA law was, concerning future plans for Iraq. The USA law is that Congress has to vote on any agreement. Shocking! This is like the law that says Congress is suppose to vote on wars; (it sure would be nice if they got back to that basic Constitutional mandate). But here's the Real Shocker: the Bush Administration wants to sign a "private contract," with Iraq, allowing the war to go on and for permanent occupation. They call this private contract a "Status of Forces Agreement." By doing it this way they claim they can avoid the hassle of going to Congress. These *()*$#8 do this all the time. We don't go to war anymore. The president makes private 'Status of Forces Agreements." We got them all over the world. They try to keep them secret. POPSBush signs bill to turn military satellites on U.S. G W Bush, aka Big Brother, is inching closer to allowing Homeland Security greater access to military satellites, despite statutes that make it illegal to use the armed forces to "execute the laws" within U.S. borders. Bush continues to subvert civil protection laws in the government's obsessive quest to 'know' everything that goes on within our borders. This shows this administrations sociopathic distrust of its citizens and a continued lack of respect for its citizens privacy.

That was spectacularly clueless, and one of the many occasions on which Obama has demonstrated that for all his fine degrees from Columbia and Harvard Law, he's ignorant of world history. First, no one at Nuremberg was permitted to file a habeas corpus petition in the American courts. Second, the Military Commissions Act provides substantially greater procedural and substantive protection than what any of the Nuremberg defendants had. Rights for foreigners accused of being terrorists that even our own service personnel don't get. A "living, breathing" Constitution whose answers, are blowin' in the wind. You do get an indirect vote on whether that's what you want — but you have to cast it through your choices for POTUS/VPOTUS and (even less directly) U.S. Senators. Judicial appointments are just one more issue on which this year's presidential election presents you with a stark, vivid choice.

One has to ask, why did all this have to happen in the first place? Why the riot gear and tear gas? The 15 min parking Lot Paranoia Law, makes it illegal to be in any downtown PUBLIC lot for any reason, for more than 15 min. It has only been used against the poor, activists and "undesirables" not breaking any constitutional laws. This week was a great victory!

Otherwise, the treasury secretary would become a more powerful -- and unaccountable -- figure even than our powerful and unaccountable president. And, as such, he would be operating in direct conflict with the Constitution. The nation's essential document makes it clear that every member of the executive branch is subject to legislative and judicial review. Congress cannot delegate its oversight authority to a cabinet member, even in a time of turmoil. The opening section of the Constitution gives all -- emphasis on all -- legislative authority to the House and Senate. Under the well-established constitutional doctrine of nondelegation, Congress cannot cede that power in the manner that Paulson's draft plan proposed -- or, for that matter, in any manner whatsoever.

POPSWhite Privilege White privilege is when you can claim that being mayor of a town smaller than most medium-sized colleges, and then Governor of a state with about the same number of people as the lower fifth of the island of Manhattan, makes you ready to potentially be president, and people don't all piss on themselves with laughter, while being a black U.S. Senator, two-term state Senator, and constitutional law scholar, means you're "untested." White privilege is being able to say that you support the words "under God" in the pledge of allegiance because "if it was good enough for the founding fathers, it's good enough for me," and not be immediately disqualified from holding office--since, after all, the pledge was written in the late 1800s and the "under God" part wasn't added until the 1950s--while believing that reading accused criminals and terrorists their rights (because, ya know, the Constitution, which you used to teach at a prestigious law school requires it), is a dangerous
